Terms of Service
Last updated
The short version
- You own your books. Libba only uses them to run the service for you.
- Libba is in beta, so keep your own copy of every manuscript.
- Libba aims for files every store accepts, but no tool can guarantee a store's approval.
These terms are the agreement between you and Libba, which is run by LMJ Media (“Libba”, “I”, “me”). By creating an account or using Libba, you agree to them. If you don’t agree, please don’t use Libba. Questions are welcome at hello@libba.app.
Libba is in beta
Libba is still being built and tested. While it’s in beta, features may change, things may occasionally break, and some work may need redoing. Always keep your own copy of your manuscript. Libba’s local and cloud saving are there to help, not to be your only backup.
Your account
- You need to be at least 16 to use Libba.
- Give accurate details when you sign up, and keep your sign-in secure. You’re responsible for what happens under your account.
- One account is for one person. Please don’t share it.
Your books belong to you
You keep full ownership of everything you put into Libba: your manuscripts, images, covers, author bios and anything else.
To run the service, you allow Libba to store, copy and process your content only as needed to show it to you, save it, sync it between your devices and turn it into the files you export. That permission ends when you delete the content or your account, apart from short-lived backups that are cleared automatically.
You confirm that you have the right to use what you upload, including any images, fonts or quoted material that belongs to someone else.
Fair use
Please don’t use Libba to:
- create or store anything illegal, or anything that infringes someone else’s rights;
- try to break, overload or get around Libba’s security, limits or payment checks;
- copy, resell or scrape the app, or use it to build a competing product.
If an account is used this way, Libba may suspend or close it.
Free use and Pro
- Free: you can design one book with every feature, theme and preview. Exporting needs Pro.
- Yearly Pro renews automatically each year until you cancel. You can cancel any time from the account settings, and you keep Pro until the end of the year you’ve paid for.
- Lifetime Pro is a one-off payment for access for as long as Libba runs. It means the lifetime of the product, not your lifetime. Lifetime access ends if the payment is reversed (for example, through a chargeback) or the account is closed for breaking these terms.
- Yearly to Lifetime: after three yearly payments, your account is upgraded to Lifetime automatically. The years don’t need to be in a row.
- Image storage: each account can store up to 300 images in its image library, on any plan. Libba shows how many you’ve used, and storage limits may change over time.
- Beta testers may be given free Pro access for an agreed period. It costs nothing, involves no payment details, and simply ends on the date shown in your account.
Payments are processed by Polar, which acts as the seller and handles tax and receipts. Polar’s own terms also apply to your purchase. Prices may change, but a change never affects a period you’ve already paid for, and existing yearly subscribers will be told before a new price applies to them.
Refunds
You can design a complete book for free before you pay, so you can see exactly what you’re getting. Because of that, payments are non-refundable, including for a change of mind or a part-used year. When you pay, you’re asking for Pro to start straight away, and you agree that this ends any right to cancel and get your money back.
If you cancel a yearly subscription, it simply won’t renew. You keep Pro until the end of the year you’ve paid for.
The exception is if Libba doesn’t work as described, for example if a technical fault stops you exporting and it can’t be fixed. In that case, email hello@libba.app and it’ll be put right, with a refund if needed. This doesn’t affect any rights you have under consumer law where you live.
Exported files and stores
Libba is built to produce clean EPUB files that meet the requirements of Amazon KDP, Apple Books, Kobo, Google Play, Barnes & Noble and similar stores. However, each store makes its own decisions and changes its rules over time, so Libba can’t guarantee that any store will accept, approve or display your book in a particular way. Please check your files and previews before you publish.
You’re responsible for what you publish, including its content and any store listing.
Closing your account
You can stop using Libba at any time. To delete your account and everything stored with it, email hello@libba.app. See the Privacy Policy for what’s deleted and when.
The legal part
Libba is provided “as is”. As far as the law allows, there’s no warranty that it will always be available, error-free or suited to a particular purpose.
As far as the law allows, Libba isn’t liable for indirect losses, such as lost sales, lost profits or lost data. Libba’s total liability to you for any claim is limited to the amount you paid Libba in the 12 months before the claim, or $50 if that’s more. Nothing in these terms limits liability that can’t legally be limited, such as for fraud.
These terms are governed by the law of England and Wales. If any part turns out to be unenforceable, the rest still applies.
Changes to these terms
If these terms change in a way that matters, I’ll update the date at the top and email account holders before the changes take effect. Continuing to use Libba after that means you accept the new terms.
